Terms of Service

The short version: Use Chaaq to track shared expenses honestly. Don't misuse it. We provide the tool — you're responsible for the accuracy of what you record. We're not a bank, payment processor, or financial advisor.
1. What Chaaq is
Chaaq is operated by CapraTrail Studios LLP ("we", "us", "our"). These Terms govern your use of the Chaaq mobile application, our website at chaaq.app, and related services (together, "the App").
Chaaq is an expense tracking application that helps you:
- Track personal splits between two people
- Manage shared group expenses
- Organize rotating savings circles (chit funds)
Important: Chaaq is an expense tracker, not a payment processor, bank, or financial institution. When you "settle" or "pay" in the app, you're recording that a transaction happened — the actual money moves outside the app (cash, bank transfer, etc.). Chaaq does not hold, transfer, or process any funds.
2. Your account
To use Chaaq, you need to create an account using one of:
- Your phone number (with OTP verification)
- Your email address and a password
- Sign in with Apple
You agree to:
- Provide accurate information when creating your account
- Keep your account secure — don't share your OTP, password, or login credentials
- Be responsible for all activity under your account
- Notify us immediately at info@chaaq.app if you suspect unauthorized access
You must be at least 13 years old to use Chaaq, or older if your country requires a higher minimum age (some EU jurisdictions require 16). If you're under 18, you should have permission from a parent or guardian.
3. Acceptable use
You agree to use Chaaq for its intended purpose — tracking shared expenses and savings. You must not:
- Use the app for illegal activities, fraud, or money laundering
- Create fake accounts or impersonate others
- Record false or misleading transactions to deceive others
- Attempt to access other users' data without authorization
- Reverse engineer, modify, or tamper with the app
- Use automated tools to scrape data or overload our services
- Harass, threaten, or abuse other users through reminders or messages sent through the app
4. Your content and data
You own the data you put into Chaaq — expense records, notes, receipts, and group information. By using the app, you grant us a limited, non-exclusive, royalty-free license to store, process, and display this data solely for the purpose of providing the service to you and the people you choose to share it with.
You're responsible for the accuracy of the information you record. If you log that someone owes you money, that's between you and them — Chaaq doesn't verify, guarantee, or enforce debts.
5. Groups and chit funds
Groups: When you create or join a group, all members can see group expenses, balances, and activity. Think carefully about who you add — group data is visible to all members of that group.
Chit funds: Chit fund features help you organize rotating savings circles digitally. You agree that:
- Chaaq facilitates tracking and organization only — it does not guarantee, enforce, or process payments between members
- The admin of a chit fund is responsible for managing collections and disbursements outside the app
- Draws, bids, and auction results within the app are for organizational purposes — they do not constitute legally binding financial contracts
- Disputes between chit fund members are between those members, not Chaaq
- You are responsible for ensuring your chit fund activity complies with applicable local laws and regulations (some jurisdictions, including India, specifically regulate chit funds; consult local counsel if you are unsure whether your activity is permitted)
6. Subscriptions and payments
Chaaq offers a free tier and a Pro tier with additional features. New users receive Pro features free for the first 12 months.
After the free promotional period, continued Pro access requires an active subscription:
- Pro Monthly: US$2.99 per month (prices may vary by region; the final price is shown by the App Store before purchase)
- Pro Annual: US$24.99 per year (prices may vary by region; the final price is shown by the App Store before purchase)
Pro subscriptions are billed through Apple's In-App Purchase system. By subscribing, you agree that:
- Your subscription will auto-renew at the end of each period unless you cancel at least 24 hours before the end of the current period
- Renewal is charged to your Apple ID within 24 hours of the end of the current period at the then-current price
- You can manage or cancel your subscription anytime via Settings → [Your Name] → Subscriptions on your iPhone, or at apps.apple.com/account/subscriptions
- Refund requests are handled by Apple per their refund policy
- No refunds are issued for unused portions of a subscription period
We may change subscription prices with at least 30 days' notice through the app or by email. Any price change takes effect at your next renewal — you can cancel before then if you don't want to continue at the new price.
7. What we promise (and what we don't)
We promise to:
- Keep the app running and your data secure to the best of our ability
- Not sell your data or show you ads
- Fix bugs and improve the app over time
- Be transparent about how we handle your information
We don't promise:
- 100% uptime — sometimes servers go down, updates happen, bugs slip through
- That calculations will always be perfect — verify important amounts yourself
- That other users will pay what they owe — we track balances, we don't enforce them
- Financial, legal, or tax advice of any kind
Chaaq is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, CapraTrail Studios LLP and its partners, officers, employees, and affiliates are not liable for:
- Financial disputes between users
- Losses resulting from inaccurate data entry by users
- Losses from unauthorized access to your account (if you shared your credentials)
- Indirect, incidental, special, consequential, or punitive damages arising from use of the app
- Service interruptions or data loss (though we work hard to prevent both)
Our total aggregate liability to you, for any claim arising from or related to these Terms or your use of Chaaq, will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US$50.
9. Termination
You can stop using Chaaq anytime. To fully delete your account and data, go to Settings → Delete Account in the app, or email us at info@chaaq.app. We process deletion requests within 30 days.
We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the service. Where possible, we'll give you notice and an opportunity to address the issue.
10. Intellectual property
The Chaaq name, logo, app design, and code are the intellectual property of CapraTrail Studios LLP, protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works from any part of the app without our prior written permission.
Your data remains yours. We claim no ownership over the content you create in the app.
11. Third-party services
Chaaq integrates with third-party services (Google Firebase for backend, Apple services for authentication and payments) that have their own terms. By using Chaaq, you also agree to comply with their applicable terms. We're not responsible for the practices of third-party services.
12. Changes to these terms
We may update these terms from time to time. When we make material changes, we'll notify you through the app or by email. Continued use after changes take effect means you accept the new terms. If you disagree with any changes, you can delete your account.
13. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which CapraTrail Studios LLP is registered, without regard to its conflict of laws principles.
Any disputes arising from or related to these terms or your use of Chaaq will first be addressed through good-faith negotiation. If that does not resolve the dispute within 60 days, disputes will be settled through binding arbitration in accordance with the rules of the applicable arbitration body in our home jurisdiction, except where prohibited by law. Where local consumer protection laws prohibit mandatory arbitration, those laws prevail.
14. Severability and entire agreement
If any provision of these terms is found unenforceable, the remaining provisions remain in full effect. These terms, together with our Privacy Policy, constitute the entire agreement between you and CapraTrail Studios LLP regarding Chaaq, and supersede any prior agreements.
15. Apple App Store
If you obtained Chaaq through the Apple App Store, the following additional terms apply and, to the extent of any conflict with the rest of these terms, prevail:
- These terms are between you and CapraTrail Studios LLP only, not with Apple. Apple is not responsible for Chaaq or its content.
- Apple has no obligation to furnish any maintenance or support services for Chaaq.
- If Chaaq fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) you paid for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Chaaq.
- Apple is not responsible for addressing any claims by you or any third party relating to Chaaq, including (but not limited to) product liability claims, claims that Chaaq fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property claims relating to Chaaq.
- You represent that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
