These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "user") and Chaaq ("we", "our", "us") governing your use of the Chaaq mobile application and related services (collectively, the "Service"). Please read these Terms carefully before using Chaaq.
By downloading, installing, or using Chaaq, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account or using Chaaq, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and our Privacy Policy. If you are using Chaaq on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of Service
Chaaq is a mobile application that provides:
- Expense splitting: Tools to track shared expenses, calculate balances, and manage group and 1:1 financial settlements
- Chit fund management: Tools to organise, track, and manage traditional chit fund (kitty party / savings group) operations digitally
- Payment reminders: Notification features to remind group members of pending payments
Chaaq is a tracking and management tool. We do not process, hold, transfer, or facilitate any monetary transactions. All actual payments between users happen outside of Chaaq through their own payment methods.
3. Account Registration
- You must provide accurate and complete information when creating your account
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised access to your account
- We reserve the right to suspend or terminate accounts that contain false or misleading information
4. User Responsibilities
When using Chaaq, you agree to:
- Use the Service only for lawful purposes and in accordance with these Terms
- Provide accurate expense and contribution information
- Resolve financial disputes between group members independently — Chaaq is not a mediator or arbitrator
- Respect the privacy and data of other users in your groups
- Not attempt to reverse engineer, decompile, or extract source code from the application
- Not use the Service to engage in any form of fraud, money laundering, or illegal financial activity
5. Expense Splitting & Chit Funds
5.1 Expense Splitting
- Chaaq calculates balances based on the information users input. The accuracy of balances depends entirely on the accuracy of user-entered data.
- Chaaq does not verify, guarantee, or enforce any financial obligations between users
- Settlement of debts is the sole responsibility of the users involved
5.2 Chit Funds
- Chaaq provides tools to organise and track chit fund operations. We do not operate, manage, or guarantee any chit fund.
- Users organising chit funds are solely responsible for ensuring compliance with all applicable local, state, and national laws and regulations, including the Chit Funds Act, 1982 (India) and any state-specific regulations
- Chaaq is not a registered chit fund company under the Chit Funds Act
- We do not hold, manage, or have access to any chit fund money
- All lottery draws, bidding processes, and payout schedules are managed by the group organiser, not by Chaaq
- Chaaq bears no liability for defaults, disputes, fraud, or losses arising from chit fund activities
Important: Users are solely responsible for the legality and management of their chit fund groups. Chaaq is a tracking tool, not a chit fund operator.
6. Prohibited Conduct
You agree not to:
- Use Chaaq for illegal gambling, ponzi schemes, pyramid schemes, or any fraudulent financial scheme
- Create fake accounts, impersonate others, or provide false information
- Harass, threaten, or send abusive messages to other users through the app
- Attempt to gain unauthorised access to other users' accounts or data
- Use automated scripts, bots, or scrapers to access the Service
- Interfere with or disrupt the Service's infrastructure
- Upload malicious content, viruses, or harmful code
- Use the Service to collect personal information of other users for unsolicited purposes
Violation of any of these prohibitions may result in immediate account termination without notice.
7. Intellectual Property
- The Chaaq name, logo, design, and all associated visual elements, software code, and content are the exclusive intellectual property of Chaaq
- You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our written consent
- You retain ownership of any content you create within the app (expense names, group names, notes). By using the Service, you grant us a limited licence to store and display this content as necessary to operate the Service.
8. Privacy
Your privacy is critically important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Chaaq, you consent to the practices described in the Privacy Policy.
9. Third-Party Services & Advertising
- Chaaq's free tier includes advertisements served by Google AdMob. These ads may use device identifiers and usage data as described in our Privacy Policy.
- We are not responsible for the content, accuracy, or practices of third-party advertisers
- Chaaq may contain links to third-party websites or services. We are not responsible for and do not endorse third-party content or practices.
- Premium subscriptions remove all advertisements
10. Premium Features & Payments
- Certain advanced features may require a paid subscription ("Chaaq Premium")
- All payments are processed through Apple's App Store. We do not directly handle your payment information.
- Subscription terms, pricing, renewal, and cancellation are governed by Apple's App Store policies
- Refunds are handled by Apple in accordance with their refund policy
- We reserve the right to change pricing with reasonable advance notice. Existing subscriptions will not be affected until their next renewal period.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses
- Any warranty regarding the accuracy, reliability, or completeness of expense calculations or chit fund tracking
We do not warrant that the app will be compatible with all devices or operating system versions.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Chaaq shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Chaaq shall not be liable for any financial losses, missed payments, chit fund defaults, or disputes between users
- Chaaq shall not be liable for any loss of data, business interruption, or damage to devices
- Our total cumulative liability shall not exceed the amount you have paid to Chaaq in the 12 months preceding the claim, or ₹500 (INR), whichever is greater
13. Indemnification
You agree to indemnify, defend, and hold harmless Chaaq, its founders, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any chit fund or financial dispute arising from activities you organised or participated in through Chaaq
- Any content you submit or share through the Service
14. Termination
14.1 By You
You may delete your account at any time from within the app. Upon deletion, all your personal data will be permanently removed in accordance with our Privacy Policy.
14.2 By Us
We may suspend or terminate your account at any time if:
- You violate these Terms or engage in prohibited conduct
- Your account is involved in suspected fraudulent or illegal activity
- We are required to do so by law or legal process
- We discontinue the Service (with reasonable advance notice)
Upon termination, your right to use the Service ceases immediately. Sections 7, 11, 12, 13, and 15 survive termination.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India.
15.2 Informal Resolution
Before filing any formal claim, you agree to contact us at info@chaaq.app and attempt to resolve the dispute informally for at least 30 days.
15.3 Jurisdiction
Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in India. You waive any objection to venue or jurisdiction in these courts.
15.4 Class Action Waiver
To the maximum extent permitted by law, you agree to resolve disputes with us on an individual basis and waive any right to participate in class actions, class arbitrations, or consolidated proceedings.
16. Changes to Terms
We may modify these Terms at any time. When we make material changes, we will notify you through the app or via email at least 15 days before the changes take effect. Continued use of Chaaq after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the Service and delete your account.
